An appeals court in New York has given President Trump a partial legal win, but not the total victory he’s claiming. The court threw out the massive civil fraud penalty—worth more than $500 million—calling it excessive under constitutional limits. However, the judges did not overturn the fraud finding itself.
In a major legal development out of New York, an appeals court on Thursday voided the roughly half-billion-dollar civil fraud penalty against President Donald J. Trump, but upheld the underlying finding that he and his business engaged in fraud — a split ruling that leaves both sides claiming victory.
The Appellate Division of the New York Supreme Court struck down the massive judgment — which had swelled to more than $500 million with interest — calling it “excessive” under the U.S. Constitution’s ban on excessive fines. However, a majority of the five-judge panel did not overturn the earlier trial court’s finding that Trump, the Trump Organization and two of his adult children repeatedly inflated asset values in financial statements to obtain favorable loan and insurance terms.
Although the financial penalty was wiped out, other non-monetary sanctions remain in place. These include restrictions on Trump and his sons’ ability to serve as executives of New York companies and ongoing court-ordered compliance oversight.
Competing Claims from Trump and New York’s Attorney General
President Trump wasted no time calling the ruling a “total victory”, echoing his long-standing argument that the case was politically motivated and that the original penalty was unjustified.
But New York Attorney General Letitia James struck a different tone, insisting the essential finding — that Trump and his business committed fraud — was upheld and that her office plans to appeal the appeals court’s decision to the state’s highest court. She also noted that key injunctive measures curbing Trump’s business operations in New York remain effective.
What Happens Next
With the civil fine eliminated at this stage, the case is poised to continue through the state’s legal system. The Attorney General’s office is expected to ask the New York Court of Appeals to review the panel’s judgment. Meanwhile, Trump’s business restrictions and supervisory orders in New York remain subject to enforcement as part of the ongoing legal battle.
Trump, his company, and two of his children remain legally liable for civil fraud. The court upheld the ruling that they inflated asset values for years to mislead banks and insurers in order to secure better loans and insurance terms.
While the huge fine was eliminated, non-financial penalties remain in place, including restrictions on Trump’s business operations in New York. That fraud label still stands.
New York Attorney General Letitia James has said her office plans to appeal the reduction of the penalty and continues to pursue enforcement options. Trump previously had to post a $175 million bond to delay asset seizures while appeals continue.
